Information Regarding Procedures by which Foreign Spouses (I)

Topic:
Foreign spouses (nationals without household registration in Taiwan;foreigners;Hong Kong and Macau residents; mainland nationals)of those holding residence in Taiwan.

Required Documents:

1. Original and copies of documents related to marriage (must be authenticated by an ROC representative office stationed abroad), original to be returned after processing.

2. Alien Permanent Resident Certificate;Alien Resident Certificate;or household registration documents or documents showing legal residence for Hong Kong or mainland-area residents in Taiwan.(original and one copy- original to be returned after processing).

3. Health certificate (as above).

4. Passport (valid for six months and with blank pages); one photocopy each of the passport’s basic information page and page showing entry into Taiwan.

5. Visa application form (applicants must personally sign for confirmation; the form can be requested at the counter or downloaded from our website)

6. Two 2×1.5-inch color photographs taken within from the last six months.

7. Other requested documents for certain individual cases.

Article 8

Receipts indicating the currency and amount charged shall be produced when payments are received. However, for certain cases as prescribed in Paragraph 1 of Article 22 of the National Treasury Law, receipts may be waived.

Article 9

These fee rates are subject to changes by the Ministry according to price fluctuations in the ROC and abroad, variations of exchange rates, and adjustments to the procedures for collecting the fees.

Standard Fee Rates for ROC Visas in Foreign Passports

Article 5

Postage and telegram charges include telegram fees incurred by the Ministry and the Missions for processing visa applications and postage charges incurred by ROC Overseas Missions for mailing visas, passports or other relevant application forms.

The aforementioned telegram fees shall be stipulated by the Ministry and may vary in different regions. The postage costs for mailing documents shall be determined according to the cost of each application incurred by the ROC Overseas Missions.

Article 6

ROC Overseas Missions shall promulgate the fee rates and their equivalent amount in local currencies. Unless, under special circumstances, ROC Overseas Missions may be exempted from promulgating the fee rates provided approved by the Ministry.

Article 7

If visa applications are denied, the application fees charged are not refundable. Exceptions will be granted only under special circumstances and with the approval of the Ministry.

The charged fees are not refundable when the issued visas are invalidated or canceled in accordance with Article 13 of the Statute.

Article 3

Fee rates are categorized into visitor visa fees and resident visa fees. The rates are:

1. Single Entry Visitor Visa: NT$1,200 per application if applied for in the ROC; US$36 per application if applied for overseas.
2. Multiple Entry Visitor Visa: NT$2,400 per application if applied for in the ROC; US$72 per application if applied for overseas.
3. Single Entry Resident Visa: NT$2,200 per application if applied for in the ROC; US$66 per application if applied for overseas.
4. Multiple Entry Resident Visa: NT$3,000 per application if applied for in the ROC; US$90 per application if applied for overseas.

If more than eight persons wish to enter and exit the ROC as a group at the same time, they may apply for a group visitor visa and each member of the group shall be charged 50% of the original fee.

Article 4

The following special handling fees shall apply to the cases listed below:

1. An additional charge of NT$800 or US$24 shall apply to applications for visas upon arrival at the ports of entry in the ROC.
2. An additional 50% charge over the rates stipulated in the previous article according to the different types of visa shall apply to Rush Handling. However, if the request for Rush Handling is made in response to emergency situations or to fulfill official duties, the applicant may be exempted from the additional charge.
3. An additional charge of NT$800 or US$24 shall apply to applications made in the ROC by visitor visa holders who apply for a visit visa or a resident visa.
4. If the country of the visa applicant charges a special handling fee to ROC passport-holders when they apply for visas from that country, the visa applicant shall be charged a special handling fee of equal amount for each ROC visa application.

The Rush Handling stipulated in item (2) means the dispatching of special personnel to process the application immediately, or the early visa issuance by the Ministry or ROC Overseas Missions according to the urgency of the application.

Article 1
These rates are prescribed in accordance with Article 14 of the Statue Governing the Issuance of ROC Visas in Foreign Passports (hereinafter referred to as the Statute).

Article 2

The prescribed fees include:

1. Visa fees
2. Special handling fees
3. Postage and telegram charges.

The aforementioned fees, specified in accordance with Article 3, 4, and 5, of the Statute, shall be charged according to the location where a visa application is submitted and shall be paid in the currency specified as follows:

1. For applications for visas made in the Republic of China (hereinafter referred to as the ROC), the prescribed fees shall be paid in New Taiwan dollars (hereinafter referred to as NT dollars).
2. For application at ports of entry in the ROC, the prescribed fees shall be paid in NT or US dollars.
3. For application made outside the ROC (hereinafter referred to as overseas), the prescribed fees shall be paid in US dollars. If paid in the local currency, the amount shall be converted by the ROC Overseas Missions from the set US dollars fee into the local currency. The fees in the local currency shall be submitted to the Ministry of Foreign Affair (hereinafter referred to as the Ministry) for approval beforehand.

Article 12

Family members of, and others accompanying, officials of specific inter-governmental organizations and foreign agencies that are based in the ROC may apply for single/multiple-entry resident visas with a duration of no longer than 5 years.

The above-mentioned persons, unless possessing official identification cards issued by MOFA, shall apply for ARCs.

Article 13

Foreign passport holder may apply for resident visas in order to: join family; pursed studies; undertake employment; invest; conduct missionary work; conduct official duties; participate in international exchange programs; and engage in other activities approved by MOFA or other relevant agencies at the central-government level.

Unless related approval is not required, the applicant shall submit documents issued by the competent authorities at the central-government level, or their authorized agencies, approving the purpose of the applicant’s visit to the ROC when applying for a resident visa.

Article 14

In the case of an application lodged by a stateless person who may lose residency of the country that issued the travel document that the applicant holds, MOFA or the overseas mission may refuse the application.

Article 15

The Enforcement Rules shall take effect upon promulgation.

Article 9

The term “short-term stay” as stated in Article 8 of the Statute refers to any planned visit to the ROC that does not exceed 6 months.

The validity of the visa, the number of entries and the duration of stay for a visitor-visa holder shall be determined by the applicant’s nationality, purpose of visit, and the type of passport the applicant holds, as well as its date of expiry.

Visitor visas shall have a validity of no more than 5 years, with an option of single or multiple entry.

Article10

Foreign passport holders may apply for visit visas for the purposes of transit; tour; visit relatives; undertake visits; undertake inspection tours; attend international conferences; conduct business; pursue short-term study; undertake short-term employment; undertake short-term missionary work; and engage in other activities in the ROC as approved by MOFA.

Applicant’s applying for the above-mentioned visa seeking to engage in profit-making activities or work shall submit documents from the competent authorities at the central-government level, or their authorized agencies, showing that such activities have been approved.

Article 11

The term “long-term stay” as stated in Article 11 of the Statute refers to a planned period of stay exceeding 6 months.

A resident visa issued by overseas mission shall be good for single entry only and its validity shall not exceed 6 months. The visa holder shall apply for an Alien Resident Certificate(ARC) after being admitted into the ROC.

Resident visas issued by MOFA within ROC territory shall be used for applying for ARCs only and shall not be used for entry into the ROC.

Article 6

MOFA and overseas missions shall review the applicant’s status, purpose of visit, and type and validity of passport before issuing the appropriate ROC visa to the applicant.

Article 7

Diplomatic Visas and Courtesy Visas as stated respectively in Paragraph 1 and Paragraph 2, Section 1, Article 7 of the Statute shall have a validity of no longer than 5 years. The number of entries and length of stay shall be determined in accordance with the applicant’s needs and the purpose of his/her visit. In cases where the duration of stay is not specified, there shall be no limit to the length of stay, provided that this does not exceed the time required for the visa-holder’s assignment in the ROC.

Article 8

The “validity” of a visa as stated in Section 2, Article 7 of the Statute refers to the time within which “duration of stay” as stated in Section 2, Article 7 of the Statute refers to the time within which the visa-holder is permitted to enter the ROC. The period of duration shall be calculated from the day the visa is issued.

The “duration of stay” as stated in Section2, Article 7 of the Statute refers to the period within which the visa holder may be permitted to stay in the ROC.

The period of “stay” shall be calculated from the day following the applicant’s admission into the ROC.

The “number of entries” as stated in Section 2, Article 7 of the Statute refers to the number of times the visa holder is permitted to enter the ROC during the validity of the visa.

Article 3

Passport holders who may apply to MOFA for a visa upon arrival in the ROC due to special needs as described in Article 6 of the Statute are passport holders from countries other than the specified countries who meet any of the following conditions and obtain approval from MOFA:

1. They have been invited to the ROC by the Central Government;
2. They have been invited to international conferences and/or activities hosted by the Central Government of the ROC;
3. Expedited entry is necessary due to major events or disaster relief programs; and
4. Other important causes.

Article 4

A foreign-passport holder who enters the ROC by visa-exemption, or who obtains a visa upon arrival, shall leave the ROC upon or before the expiration of permitted legal period of stay. However, in the following circumstances, the person may submit supporting documents and apply to the Bureau of Consular Affairs or its subordinate agencies for a visitor visa before the expiration of permitted legal period of stay;

1. The person is afflicted with an acute, severe disease, excluding infectious, mental or other diseases that may pose a threat to public health or social order;
2. Natural disasters or forces majeur; and
3. Other justifiable causes.

Article 5

When a foreign-passport holder applies for an ROC visa, the passport holder shall submit to MOFA, or to ROC Embassies, Consulates, representative offices abroad, or other agencies(hereinafter referred to as ROC overseas missions) authorized by MOFA, a completed visa application form, a valid passport and photograph(s) taken within the past six months. Unless regulated otherwise by treaties or agreements, a “valid foreign passport” as stated in the preceding section shall be valid for or over 6 months.

MOFA and overseas missions may request the applicant to undergo and interview or submit travel plans, proof of familial relations, results of health examinations, proof of criminal record, proof of financial status, proof of the purpose of visit, information regarding the applicant’s contacts, relatives or guarantor in the ROC, and other documents as required for the review process.
